Artifact Consignment Contract

I (“the consignor”) have read Artifact Creative Recycle LLC’s Consignment Contract. I understand that by consigning items at Artifact I am agreeing to all of the Terms and Conditions outlined below.

TERMS AND CONDITIONS
I hereby consign to Artifact Creative Recycle LLC (Artifact) the described item(s) which Artifact, as agent, will offer for sale in the Artifact storefront. For its services, Artifact will receive and retain, from the proceeds of the sale, commission from the consignor based on the provided outline. Artifact will pay the consignor the net proceeds received and collected from the sale of the property after receiving payment from the buyer and deducting its commissions. Artifact in its sole discretion may cancel the Consignment Contract and return the property to the consignor at any time. The consignor may also cancel the Consignment Contract at any time and elect to collect one or all of their items from the store. If the consignor elects to remove an item from the store this item cannot be brought back at a later date. In the case that an item(s) is returned because a customer was not fully satisfied with the purchase the consignor’s account will be debited for all returns accepted under Artifact’s return policy. The consignor agrees to pay any balance for returns that may be charged to their account.

COLLECTING CONSIGNMENT MONEY
Artifact does not contact you once items have sold. It is the sole responsibility of the consignor to contact Artifact and come into the store to collect consignment money. Artifact pays out consignment balances in cash for balances of $50 or less, and with a check or ACH direct deposit via SimplePay ($3 fee) for balances of more than $50. Consignment balances can be paid out via SimplePay direct deposit by setting up their ACH account information through the consignor's online account portal and then emailing the store for a payout, or with a check mailed via USPS, when the consignor lives out of the state of Oregon. Consignment account balances are good for 1 year from the date of sale. Any account that has not had activity within 365 days will be deleted. Artifact consignment account balances may not exceed $2000. If an account exceeds $2000 Artifact will contact the consignor to initiate a payment. A payout must be initiated via SimplePay or a check picked up within one week of being contacted. It is appreciated for consignor's to keep up with their consignment balances and pick up larger balances at their soonest convenience.  

DATA PROTECTION CLAUSE
Artifact is not responsible for the login and data security related to a consignor's consignor access portal. If an account is hacked by a 3rd party and retrieves funds from the consignors account, Artifact is not responsible for the lost funds of this consignment account. 

LOST CHECK POLICY
The first time a consignor loses a check, they should contact the store immediately and we can help reissue a new one. If a consignor loses a check more than once they will be required to sign up for our SimplePay direct deposit option and receive payment via direct deposit. 

DISCOUNTING ITEMS
All items on consignment stay at the agreed-upon price for the first month unless the consignor has been called and an offer has been accepted, there is a store-wide sale, a customer has a one-time coupon, or an item has a flaw that wasn't previously noted and a discount is necessary to make the sale. After one month, consigned items will go on sale at the discretion of Artifact. This means that expired items can be discounted up to 90% of the starting price point. 

DONATING & RETURNING ITEMS
Items on the sales floor for 60 days or longer are considered expired. Consignors have a 1 week grace period after the expiration date to pick up any items. It is up to the consignor to keep track of possible expired items and their grace period dates. After the 1 week grace period items are subject to possible donation. For items priced over $100, Artifact will contact the consignor after the item has expired. The consignor will have 1 week to pick up the item. 

HELP BRINGING ITEMS INTO THE STORE
If the seller agrees to have an Artifact employee assist in unloading an item from the consignor's vehicle in order to bring it into the store to sell, the consignor then agrees to indemnify and not hold responsible, Artifact Creative Recycle LLC and it's employees, from all liability if the item(s), vehicle, or consignor become damaged or physically hurt in the process of bringing in items to the store. This includes but is not limited to chips, dents, scratches, rips, tears, cracks, stains or if either party hurts themselves in carrying the items. 

TERMS & CONDITIONS AGREEMENT
By agreeing to the Terms and Conditions, and placing the items for sale at Artifact, I, the consignor, guarantee that all items consigned to Artifact for sale are lawfully and entirely owned by me or I am acting on behalf of a person(s) who has given me the authority to sell such items on their behalf. I guarantee to indemnify Artifact- for any damages, penalties, fines, fees or judgments for any issue arising due to the rights of the lawful owner of the merchandise being placed on consignment. Artifact does not provide any type of insurance or guarantee to consignors for items placed on consignment that covers any loss or damage to the consignor’s property while in its possession. Artifact will take diligent care of the consigned pieces as to the best of its ability. Artifact does not cover losses to consigned property for theft or damages. This includes any damage caused by a customer, employee, fire, flood, earthquakes, stains, tears, missing pieces, broken pieces, or any other damage with no exclusions of man-made or natural damages to consigned items. By leaving items on consignment I release Artifact against any loss or damage to my items while in possession of Artifact.

By accepting this form and consigning with Artifact Creative Recycle LLC (Artifact), I certify that I (“the consignor”) fully understand and agree to all of the Terms and Conditions in this Consignor Contract. I also state that all information given when “Checking-In” at the buying counter at the store is true and correct.
